These Terms and Conditions ("Agreement") govern your use of the website and services provided by Saints of Steel, a business operated in Johannesburg, South Africa, by Peter Driessel and Paul Ellington. By accessing our website, placing an order, or commissioning a sculpture, you agree to be bound by these Terms.

1. Definitions

"Client" refers to the person or entity commissioning a sculpture or purchasing an artwork from Saints of Steel.

"Commissioned Work" refers to a sculpture or art piece created specifically for the Client.

"Website" refers to www.saintsofsteel.co.za and any affiliated digital platforms.
2. Artistic Ownership and Intellectual Property

All creative concepts, designs, moulding techniques, and finishing methods remain the intellectual property of Saints of Steel.

While the physical sculpture becomes the Client's property upon full payment, no duplication or commercial reproduction of the design may be undertaken without written permission from Saints of Steel.

We reserve the right to create derivative works based on similar styles unless exclusivity has been pre-negotiated.
3. Commissioned Work and Refunds

Each commissioned piece is handcrafted and one-of-a-kind, designed to reflect Saints of Steel's signature style.

Due to the bespoke nature of our work, all payments for commissioned sculptures are strictly non-refundable.

Under South African law, as per the Consumer Protection Act (CPA), goods that are custom-made or specifically altered at a consumer's request are exempt from the general right to return, provided the supplier clearly discloses this, which we hereby do.
4. Payment Terms

A non-refundable booking fee of R5,000 is required to confirm a moulding session.

The full balance of the commissioned sculpture must be paid at least one day before the scheduled session.

The sculpture will not be released until full payment has been received.

Payment may be made via EFT or other approved methods outlined on the website.
5. Production Timeline

Commissioned pieces typically take 14 to 21 working days after the moulding session to complete.

Expedited options may be available at additional cost.

The timeframe may vary based on the complexity of the piece, metal availability, or client-requested adjustments.
6. Shipping and Delivery

All shipping costs are the responsibility of the Client.

Clients may organise their own courier, or Saints of Steel can provide a shipping quote upon request.

We are not liable for delays caused by third-party couriers or customs, nor for damage in transit unless insured by the Client.
7. Moulding Session and Liability
​

Clients must be 18 years or older to participate in any moulding session.
-
The Client acknowledges the physical nature of the casting process and agrees to participate at their own risk.

The Client understands and consents that in the creation of anatomical sculptures, such as buttocks, breasts, or full-body castings, plaster may be applied directly by hand over intimate areas including the nipples, penis, anus, and vagina. Every effort will be made to ensure this is done respectfully, professionally, and with due care.

We are not liable for skin irritation, allergic reactions, or injury resulting from the moulding materials or process.

Personal belongings brought to the session are the sole responsibility of the Client.
8. Privacy and POPIA Compliance

Saints of Steel complies fully with the Protection of Personal Information Act (POPIA).

Client data is collected only for communication, booking, and artwork delivery purposes.

Your information will never be sold or shared without your express written consent.
9. Use of Visual Documentation
​

No photos or videos will be taken during the moulding or sculpting process unless approved in writing.
-
We will never share images of you or your artwork publicly without your written consent.
10. Mould and Image Archiving
​

Original moulds are stored for up to one year for possible re-commissioning.

After one year, Saints of Steel reserves the right to dispose of the mould unless requested otherwise in writing.

Digital images or documentation, if captured, are retained securely for up to one year.
11. Cancellations and Rescheduling

Cancellations made less than 7 days before the session will incur a 100% cancellation fee.

Rescheduling is allowed within 7 days of the appointment but will attract a R1,000 admin fee.
12. Force Majeure
​

Neither party is liable for delays or non-performance due to events beyond reasonable control, including natural disasters, pandemics, or civil unrest.

In such events, Saints of Steel will offer a rescheduling option. However, payments remain non-refundable.
13. Limitation of Liability
​

Saints of Steel’s liability for any claim related to our services is limited to the amount paid by the Client.

We do not accept liability for indirect, incidental, or consequential damages.
14. Dispute Resolution and Governing Law
​

Any disputes will be first addressed through good-faith mediation.

This Agreement is governed by the laws of the Republic of South Africa, and any legal action must be brought in a court of competent jurisdiction within South Africa.
15. Amendments
​

We reserve the right to update or modify these Terms and Conditions at any time.

Continued use of our website or services indicates acceptance of any revised terms.
